Operator and scope

Madeira Charter is a brand of Margem Amena, Lda., registered at Estrada do Aeroporto 65, Moradia 76, 9060-382 Funchal, Madeira, VAT PT519267184. It offers private boat tours on Madeira Island, departing from Funchal Marina. The operator is responsible for the vessel, the skipper and operational delivery.

Prices, taxes and capacity

Published prices cover the complete private charter for groups of 1 to 8 guests, including VAT, skipper, fuel, insurance, paddleboard, snorkelling masks and snorkels, pool noodles, life jackets, a bottle of wine, fruit, Bluetooth music and cleaning fees. The price is per boat, not per person.

Booking process and confirmation

A booking is created after selecting the tour, date, time slot and providing guest details. Availability is verified server-side. A booking is only confirmed after availability validation and payment confirmation by the system. A request without confirmed payment does not constitute a booking.

Payment and security

Payment is processed securely by Stripe. The server validates the price, guest count and availability before creating the payment session. Prices submitted by the browser are not accepted without server-side validation.

Skipper authority and sea conditions

The skipper has final authority over departure, route and continuation of the experience. Decisions based on safety, weather, sea state or maritime restrictions are final. The route may be changed without prior notice. Wildlife encounters are not guaranteed.

Guest obligations and conduct on board

Guests must arrive on time, follow safety instructions and respect on-board rules. Behaviour that puts people, the vessel or the environment at risk may result in immediate termination of the experience without refund. Minors must be accompanied by a responsible adult.

Cancellation, rescheduling and force majeure

The applicable cancellation policy is shown before payment and recorded with the booking. In the event of unsafe sea conditions, the operator will communicate the available options, which may include rescheduling, credit or refund. Force majeure events not attributable to the operator may limit refund options.

Liability, complaints and governing law

Madeira Charter is not liable for indirect damages, loss of personal belongings or itinerary changes for safety reasons. Complaints must be submitted in writing within 30 days. These terms are governed by Portuguese law. Disputes are subject to the jurisdiction of the Funchal courts, without prejudice to alternative dispute resolution mechanisms.
